Over time, identity theft law has changed tremendously, for the better. Thousands of people around the world fall victim to this crime each and every year and to make sure that this doesn't happen to you there are a few things that you can do. According to identity theft law this crime is a form of fraud and is considered as being what police call a distanced crime. In other words it means that it is a crime committed on a person in which the thief is not physically going near the victim but still causing them damage or loss. Although the identity theft law tends to differ from one state to the next, still police squads and crime units are always working together to fight against the crime.

As long as the thief is caught the will be sentenced. There he will usually be given a specified bail amount and if they can pay it they will not have to wait in jail until their trial. Otherwise they will be left there until the first day of their trial which may not be for months afterwards. Often but not all the time, victims are called in to be on the witness stand in cases of identity theft fraud. This can be a scary thing to do but you want to make sure that he is going to be punished to the full extent and ensure that this does not happen to anyone else. On average a person charged with identity theft will receive between three to five years in prison at a minimum. More people in authority and specifically government recognize that this is a global issue and that the perps who commit these crimes need to be put away for long sentences of time.

The identity theft law is a bit holey in areas of financial loss however. If you go through court you should be able to get your credit cards companies to reimburse you the money especially if you have adequate protection in place such as insurance. Money taken out of bank accounts is usually gone for good unfortunately because there is no way to insure it and even if the banks know that you have been a victim of identity theft there is not much that they can do. This is why it is so important to do everything that you can to protect yourself and not become a victim of identity theft.
